Court bars IEBC from declaring Uhuru Kenyatta president after Raila bowed out of the race

It’s not yet victory for Jubilee even as Raila Odinga officially withdrew from October 26th repeat presidential election. Initially many people thought Uhuru Kenyatta would just be sworn in as president since he’s the sole remaining candidate in the race. But the court has delivered a contrary ruling.

Activist Okiya Omtatah was quick to move to the court under a certificate of urgency to seek an injunction to bar the the IEBC from declaring Uhuru Kenyatta as president in the wake of Raila’s withdrawal from the presidential race.

The High Court ruled in favor of Omtatah. The court injunction read as follows;

“Pending the hearing and determination of this application and /or petition herein the Honorable Court be pleased to issue a temporary order of injunction restraining the 1st and 2nd respondents, its agents servants or any person claiming to act under its authority from proceeding to announce president Uhuru Kenyatta as the President elect following the withdrawal of the presidential and the deputy presidential candidates representing the National Super Alliance.”

The order also stated that the applicant had established a prima facie case and that the respondents would not suffer prejudice if the order were granted.
