Raila Odinga, Moses Wetangula And Kalonzo Musyoka Dealt A Heavy Blow By The Woman Whose Matatu Was Burnt During Cord Anti-IEBC Demos

A matatu belonging to Agnes Macharia was torched in Mathare on June 6th 2016 during Cord’s anti-IEBC demonstrations.

Ms Macharia moved to Court to sue Raila Odinga, Kalonzo Musyoka and Moses Wentangula. She wanted the court to compel the three Cord leaders to compensate her for the lose she incurred during Cord demos.

Cord leaders through their lawyer Antonny Oluoch objected the suit arguing that the incident was of a criminal nature and couldn’t be handled by a constitutional court.

The Joseph Onguto today ruled in favor of Ms Macharia saying the court had the jurisdiction to hear and determine the matter.

The case will proceed at a later date this month, only the judge will determine whether Cord will compensate Ms. Macharia or not.

Cord lawyer had argued that the responsibility of maintaining law and order for any individual or classes of people including during legal demonstrations rested with the Inspector General  of police and other law enforcement agencies, and not with Raila, Kalonzo or Wetangula.
