Krispah’s legal team refutes claims of paying Dexta Briyanka to return the ‘Ndovu ni Kuu’ hit song back on YouTube

Krispah can finally relaxed after the ‘Ndovu ni Kuu’ hit record got returned back on YouTube after it was pulled down by upcoming artiste Dexta Briyanka who claimed that the song infringed on his intellectual property.

Through his Lawyer Liz Lenjo who is an IP, and Entertainment Lawyer, Dexta Briyanka agreed to withdraw his claims immediately and restore the ‘Ndovu ni Kuu’ hit song back on YouTube.

“Our client, Ndovu Kuu, a happy to note that his song ‘Ndovu ni Kuu’ is back on YouTube and that the claim filed by Dexta Briyanka has been withdrawn.” the official press statement released by Lawyer Liz Lenjo, an IP[Interlectual Property] and Entertainment Lawyer read in part.

“The facts of the case are as follows: On Friday 16th July 2021, Dexta filed a false claim with YouTube to the effect that there was a copyright infringement on his work, by Ndovu Kuu in this song. It was baffling to our client given that all the original masters and recordings were created by Ndovu Kuu. In addition, the song had been on YouTube and had even trended on other platforms like Tiktok for more than a month, with no complaint from Dexta or anyone else.” the statement went further.

Liz Lenjo went further to state that whatever Dexta Briyanka did is an offence under the Copyright Act Section 35B(8) that is punishable under law with a fine not exceeding KShs. 500,000 or a 5-year term in prison or both.

“As a professional artist, Ndovu Kuu sought legal counsel with us, and we immediately wrote a demand letter asking Dexta to withdraw the false and misleading claim and restore our client’s content.

It is an offence under the Copyright Act Section 35B(8) and has criminal sanctions of a fine not exceeding KShs. 500,000 or imprisonment of a term not exceeding 5 years or both.

On Tuesday 20th, Dexta sent a text message to our clients via his management team, that he shall withdraw his claims immediately and restore my client’s song on YouTube.” the press statement released by the Counsel for Ndovu Kuu’s management read on.

Liz Lenjo stressed that no money was paid to Dexta Briyanka for compensation because he has no entitlements whatsoever to claim anything from the song.

Krispah and his management together with the legal team opted not to sue Dexta Briyanka for criminal and civil wrongs as long as he refrains from making false statements and he sets the record straight once and for all.

A few days ago, Dexta Briyanka alleged that he was paid Kshs. 200,000 to return the ‘Ndovu ni Kuu’ song back on YouTube. This has been refuted profusely by Krispah’s legal team that is led by Liz Lenjo.

“No monetary or other arrangements were made with him as he has no entitlements to any part of the song. We hope he shall cease and desist from making false statements and claims in the public domain. Our clients has extended an olive branch to Dexta, and will not sue him both for criminal and civil wrongs for as long as he refrains from making false statements and he sets the record straight.

Ndovu Kuu thanks his fans for their support and urges all artistes to work professionally and represent themselves to the world appropriately.” the statement concluded.

The ‘Ndovu ni Kuu’ hit song is already back on YouTube without Krispah paying a dime to Dexta Briyanka as he recently claimed.

Krispah might have set precedence on the correct way of handling such matters that have recently become rampant today.

Mejja has been a target of many upcoming artistes who usually lay copyright claims on YouTube for his songs to be taken down.

Maybe Mejja should hire Liz Lenjo to help him fight his legal battles.
