Why Maxine Wahome is not in jail after late Asad Khan’s assault allegations

Maxine Wahome’s lawyer has stated that his client has not been accused of any wrong doing in connection with Asad Khan’s recent injuries, where the rally driver almost lost his life and is still fighting to stay alive in hospital.

Maxine Wahome is not an accused person, according to Andrew Musangi, because she has not been charged with any crime and no accusation has been made against her.

“She is merely being held to aid with investigations, which she has readily consented to do.In this sense, she has consented from the start to assist detectives in all elements of the investigation, including handing up access to the residence and all mobile phone equipment,” Says Mr Musangi.

Maxine, according to the lawyer, did not leave the premises until the police arrived to start the inquiry, at which point she provided them full access to the flat and briefed them on everything that happened that day.

“The glass broke and Asad suffered a nasty cut wound which bled heavily resulting to his hospitalization. Unfortunately, the injured person is unconscious and so unable to authenticate the events of that morning, but we are convinced that the facts will be validated once he recovers.”

“We informed the court that the injury was self-inflicted when the injured person alternated between kicking a window and gaining access to the balcony where Maxine had taken refuge,” Maxine’s lawyer said.

This comes as Asad continues to fight for his life at the High Dependency Unit. Asad is alleged to have been injured after a domestic dispute with his girlfriend Maxine.

He stated that the court has since decided that the investigators should wait for Asad’s recovery in order to fully understand the facts of the case.

Milimani Senior Principal Magistrate Bernard Ochoi granted Maxine Sh100,000 cash bail awaiting investigations.

Maxine will continue to assist the investigating authorities, according to the lawyer, and she should not be detained if there are no compelling or justifiable reasons to do so.
