Nyashinski has asked the court for more time to prepare his defense as his Nigerian accuser appears to have an upper hand and could force him to pay millions in damages.
Nigerian producer Sam Eliapenda Jedidah alias Sam Eli sued Nyashinski for breach of contract cutting him out in lucrative deal worth millions.
Sam Eli accuses Nyashinski of signing an endorsement deal with the Chinese based global smartphone Company listed as 2nd defendant in the civil suit No.E617/2023.
The Nigerian producer claims he own rights to Nyashinski’s songs some of which he used to promote phone being sold by Tecno Kenya Limited.
Sam Eli sued Nyashinski for Copyright infringement as he has not benefited from the musician’s contract with the Chinese phone maker.
The Kenyan rapper signed an endorsement deal with Techno Kenya in May 2023, pocketing all the money alone without giving Sam Eli his cut.
In his lawsuit, the Nigerian music producer accused Nyashinski of using the hit song ‘Wach Wach’ which he produced, to promote, advertise and endorse the Tecno Camon 20.
In February 2024, through his legal representative, producer Sam Eli had requested the court to issue directions that Nyashinski produce royalties reports for five songs he produced for his ‘Lucky You’ album namely ‘Flowers’, ‘Wach Wach’, ‘Too Much’, ‘Showman’ and ‘Top Form’.
In addition Sam Eli also requested that Nyashinski produce brand ambassadorship agreement he signed between his company GETA International limited (where he is the sole director) and Tecno Kenya Limited, under which The Chinese company was able to use the song Wach Wach to market their device.
Sam Eli maintains that as co-owner of Publishing Rights to the song ‘Wach Wach’, he didn’t receive any money from the deal and that his effort to pursue the same by reaching out to Nyashinski didn’t bore any fruit.
The court on Wednesday March 13, 2024, agreed with Sam Eli and directed that Nyashinski produces all set of documents requested.
Nyashinski’s defense team had argued that they could not produced the brand ambassadorship agreement between the rapper and Tecno Kenya because of a non-disclosure agreement.
However, Justice Selina Muchungi ordered Nyashinski to produce all set of documents requested by Sam Eli.
The judge also agreed with the Nigerian music producer to be granted seven days for perusal of the documents once Nyashinski submits them.
Nyashinski’s legal team agreed to comply with the court order to comply and serve the documents within 14 days.
