Ngoma Festival cleared by High Court of Kenya

The High Court sitting in Nairobi has today the 24th October 2018 issued orders dismissing an application by STALWART ENTERTAINMENT LTD that was seeking to stop NGOMA FESTIVAL LTD from using the name “NGOMA FESTIVAL”.

NGOMA FESTIVAL LTD put up a spirited defense to the allegation of passing off and claim to the name ” NGOMA FESTIVAL ” allegedly by “NGOMA FESTIVAL LTD “. High Court Judge, Lady Justice Maureen Odero agreed with Lawyer Kepher Ojijo’s submissions on behalf of NGOMA FESTIVAL LTD and ruled in their favor. The input of the ruling is that NGOMA FESTIVAL LTD is free to use the name as indeed the registrar of companies did lawfully register the same as a company.

Lady Justice Maurine Odero allowed Ngoma Festival Limited to hold their event on Saturday, 27th October 2018 without any interference. In her ruling, she noted that the application was baseless, malicious and an abuse of court process. Mr. Mutua and the Plaintiffs- Stalwart Entertainment Ltd were ordered to pay costs to Ngoma Festival Limited (defendant)

The event, Ngoma Festival; Ogopa Vs Calif is set to take place at Uhuru Gardens on Saturday, 27th October 2018 and promises to be one for the books. There will be performances from Wyre, Avril, Nonini, Sanaipei Tande, P-Unit, Kenzo, Big Pin, Jua Cali, Mejja, DJ Joe Mfalme, DJ Hypnotic, and DJ Namoski. The MCs for the night will be MC Phillipo and Jalang’o.
